Privacy Notice

This policy explains what information we collect on MovingUtah.com, how we use and share it, and the choices and rights you have.

1. Who we are

This website, MovingUtah.com, is operated by Scott Buehler, a dual-licensed real estate agent and mortgage loan originator serving Utah. Real estate brokerage services are provided through Real Broker, LLC (Utah license 14208056-SA00). Mortgage services are provided through Guild Mortgage Company (NMLS #3274), where Scott Buehler is a licensed loan originator (NMLS #1794818). In this policy, "we," "us," and "our" refer to Scott Buehler and MovingUtah.com.

2. Your acceptance of this policy

This Privacy Notice applies to MovingUtah.com (the "Site"), the related sites and tools we operate, and the information we collect through any web page, mobile interface, email, form, calculator, or program we offer, however it is collected. It does not apply to third-party websites, applications, or services we do not control.

By accessing or using the Site, submitting your information, or using our services, you agree to this Privacy Notice and to our Terms of Use, into which this policy is incorporated by reference, and your use constitutes your electronic signature. If you do not agree, please do not use the Site. You may withdraw your consent to certain uses at any time through the opt-out procedures described below.

3. Information we collect

We collect information you provide directly and information collected automatically when you use the site.

Information you give us

  • Contact details such as your name, email address, phone number, and mailing or property address when you fill out a form, request a home valuation, use a calculator, take a quiz, or contact us.
  • Financial and transaction details you choose to share in connection with a real estate or mortgage inquiry, such as price range, timeline, or general loan scenario inputs.
  • Any messages or information you send us by email, text, or through a scheduling tool.

Information collected automatically

  • Device and usage data such as IP address, internet service provider, browser type and version, operating system, device type, pages viewed, links clicked, referring and exit pages, approximate location derived from IP address, and the dates and times of your visits.
  • Cookies, pixels, tags, web beacons, software development kits, and similar technologies placed by us and by our analytics and advertising partners, including Google (Google Analytics and Google Ads) and Meta Platforms (the Meta Pixel and Conversions API), that record your activity on the site.
  • Online identifiers and advertising identifiers, including cookie IDs and device identifiers, and the events these tools record, such as page views, form submissions, calculator and quiz interactions, and valuation requests, which may be associated with your browser or device over time.

4. How we use your information

We use the information we collect to:

  • respond to your requests, answer questions, and provide real estate and mortgage services;
  • send you the information, valuations, market updates, or newsletters you request;
  • operate, maintain, and improve the website and its tools;
  • measure the performance of our marketing, understand how visitors find and use the site, and build audiences for advertising;
  • show you relevant ads on other websites, apps, and platforms such as Google and Meta (Facebook and Instagram), including ads based on your prior visits to this site, which is known as remarketing, retargeting, or cross-context behavioral advertising;
  • comply with legal, regulatory, and licensing obligations; and
  • detect, prevent, and address fraud, abuse, or security issues.

5. Text messages and phone calls (consent)

When you submit your contact information, provide your phone number, or ask us to contact you, you give your express written consent to receive communications from Scott Buehler at the email addresses and telephone numbers you provide. These communications may include calls and text messages (including SMS and MMS) made for marketing or servicing purposes using automated technology, including an automatic telephone dialing system, auto-texting technology, artificial or AI-generated chatbots, and prerecorded, artificial, or AI-generated voice calls. Your consent also confirms any electronic communications you have previously received from us.

By providing your number, you represent and warrant that: (1) you are at least 18 years old; (2) you reside in the United States or Canada; (3) you are the subscriber or customary user of the number, or you have the account holder's authorization to provide it; (4) the phone numbers and email addresses you provide are accurate, and you will notify us if you release or transfer a number; and (5) you are not registered on a national or state Do-Not-Call list, or you grant us a waiver to contact you at the number provided.

Consent is not a condition of buying any property, good, or service, or of receiving real estate or mortgage services. Message and data rates may apply, and message frequency varies because the salesperson who communicates with you determines how often you are contacted. You can opt out of text messages at any time by replying STOP, and reply HELP for help. To stop emails, use the unsubscribe link or reply UNSUBSCRIBE. To stop phone calls, tell us by phone, text, or email. We will make a commercially reasonable effort to honor opt-out requests, and you may receive one final message confirming your opt-out. Carriers are not liable for delayed or undelivered messages.

Mobile information and SMS consent

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-message originator opt-in data and consent, and the related personal information you provide, will not be shared with any third parties, except as required by law or as necessary to deliver the SMS services you have requested, such as our messaging-platform provider. We do not sell or share your mobile phone number or text-message consent with third parties for their own marketing purposes.

Canadian residents

In addition to the consent above, Canadian residents agree to the following with respect to Canada's Anti-Spam Legislation, the Personal Information Protection and Electronic Documents Act, and applicable provincial law, including Alberta's Personal Information Protection Act and Quebec's Act respecting the protection of personal information in the private sector: (1) you agree to the use and disclosure of personal information described in this policy; (2) our communications may continue until you opt out, which indicates you are no longer considering real estate opportunities or the services we provide; and (3) your personal information may be transmitted to, used in, and stored in the United States.

6. How we share information

We do not sell your personal information for money. We may share information in these limited situations:

  • Service providers who help us run the site and our business, such as hosting, analytics, email and text messaging, scheduling, and customer relationship tools, under agreements that limit their use of the data to providing services to us.
  • Advertising and analytics partners such as Google and Meta Platforms. Through the cookies, pixels, and tags described above, these partners receive online identifiers and information about your activity on the site, and in some cases a scrambled and irreversible version of contact details you have submitted, so we can measure our marketing and show you relevant ads elsewhere. Under some state privacy laws this use of advertising technology is treated as a "sale" or "share" of personal information, even though no money changes hands. You can opt out as described below.
  • Transaction partners needed to deliver the services you request, which may include the real estate brokerage, the mortgage lender, a referred agent, title, escrow, insurance, or similar parties, who are permitted to use the information only in connection with your transaction.
  • Legal and safety disclosures required by law, regulation, subpoena, court order, or a request from a law enforcement, public safety, or government agency, or to protect rights, property, or safety. We cooperate with law enforcement in identifying persons who use our services for illegal activity and may report activity we reasonably believe to be unlawful.
  • Business transfers in connection with a merger, sale, acquisition, financing, or reorganization of the business.

We do not share information that you provide as part of a mortgage application or other regulated financial transaction with advertising partners for their own purposes, and we do not knowingly share precise financial-application details through advertising pixels.

7. Cookies, pixels, and advertising

We use cookies and similar technologies, including pixels, tags, and web beacons, to operate the site, remember your preferences, measure traffic, secure your account where you create one, and support our marketing. Cookies are small files stored on your device. Some are strictly necessary for the site to function, while others are used for functionality, analytics, and advertising.

Your privacy choices (opt out)

We do not ask you to accept cookies before they are set. Functional, performance, and advertising cookies are on by default, and you can turn any of them off at any time through Your Privacy Choices, also linked as Cookie Preferences in the footer of every page. Strictly necessary cookies cannot be turned off because the site does not work without them. When you turn a category off we stop loading those tools, remove the cookies in that category that we are able to reach from this site, and tell Google and Meta to treat your browser as opted out. Your choices are stored in the browser you are using, so repeat them on any other browser or device. Clearing your browser storage also clears your choices, and the defaults apply again.

Turning off advertising cookies is how you opt out of the sale or sharing of your personal information for targeted advertising, described in section 8. The Allow Sale or Sharing for Targeted Advertising control and the Advertising cookie control in that dialog set the same preference.

Analytics

We use Google Analytics to understand how visitors find and use the site. Google Analytics uses cookies and similar identifiers to collect information such as the pages you view, how long you stay, and how you arrived. Turning off performance cookies in Your Privacy Choices stops it for this site. You can also opt out of Google Analytics across all websites by installing the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.

Advertising and remarketing

We use Google Ads and the Meta Pixel (Facebook and Instagram), and we may use the Meta Conversions API, to advertise this site and to reach people who have visited it. Third-party vendors, including Google and Meta, use cookies and device identifiers to serve ads based on your past visits to this and other websites. Because these cookies and identifiers are placed by those vendors rather than only by us, turning off advertising cookies here stops those vendors collecting through this site but may not stop you from seeing their ads elsewhere.

Scrambled contact identifiers

If you submit a form on this site while advertising cookies are on, we may allow an advertising partner to receive a scrambled version of contact details such as your email address or phone number. Meta calls this advanced matching. The detail is converted on your own device into a fixed code that cannot be turned back into the original text, and the partner uses that code only to check whether it matches an account they already hold, so that we can tell how well our advertising is working. We do not send the contents of your message, anything you type into a search box, or the details of a mortgage inquiry. If you turn off advertising cookies in Your Privacy Choices, none of this takes place.

How to opt out of interest-based advertising

  • Google ad personalization, including Google Ads and Google Analytics advertising features: myadcenter.google.com and adssettings.google.com.
  • Meta ad preferences for Facebook and Instagram, in the Ad Preferences and Accounts Center sections of your Meta account.
  • Network Advertising Initiative industry opt-out: optout.networkadvertising.org.
  • Digital Advertising Alliance industry opt-out: optout.aboutads.info.

Browser controls and opt-out signals

Most browsers let you refuse or delete cookies through their settings, though some features may not work properly if cookies are disabled. Because there is no common industry standard for "Do Not Track" browser settings, we do not currently respond to Do Not Track signals. Where required by law, we honor recognized browser-based opt-out preference signals, such as Global Privacy Control (GPC). When you visit the site using a browser or extension that sends a GPC signal, we treat it as a request to opt out of the sale or sharing of personal information and of targeted advertising for that browser, to the extent the law that applies to you provides that right.

8. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of the personal information we hold about you, and to opt out of certain sharing, targeted advertising, or profiling. To exercise any of these rights, contact us at [email protected]. We may need to verify your identity before responding, and you may use an authorized agent to submit a request where the law allows. We will not discriminate against you for exercising your rights by denying you goods or services, charging different prices, or providing a different level or quality of service, although we may, where the law allows, offer a different price or service level if the difference is reasonably related to the value of your data.

You can also update or correct your information, or ask us to delete or deactivate it, by contacting us at the email above. Because of backups and records of deletions, some residual information may remain after a deletion request, and changes cannot be applied to information we have already provided to a third party.

California residents

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, California residents have the right to know what personal information we collect and how we use it, the right to request deletion, the right to correct inaccurate information, the right to limit the use of sensitive personal information, and the right to opt out of the sale or sharing of personal information. We do not sell personal information for money. We do use advertising technologies that may be considered a "sale" or "share" for cross-context behavioral advertising under California law. To opt out, turn off advertising cookies in Your Privacy Choices (section 7), use the advertising opt-out controls above, send a Global Privacy Control signal, or contact us using the details below. California residents may also request information about our disclosure of personal information to third parties for their direct marketing purposes by sending a request labeled "Request for California Disclosure Choices" to the email above with your name and contact details.

Utah and other state residents

Residents of Utah, under the Utah Consumer Privacy Act, and residents of other states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Texas, and others, may have similar rights, which can include the right to access, delete, and obtain a copy of personal information, and to opt out of targeted advertising and certain sales of personal information. We honor verified requests as required by the law that applies to you.

9. Data security and retention

We use reasonable administrative, technical, and physical safeguards to protect your information. Access to personal information is limited to a small number of authorized people who need it to do their work and is protected by access controls. We use encryption to protect sensitive information transmitted over the internet, and we review our security practices on a regular basis. No method of transmission or storage is completely secure, and electronic communications and databases are subject to errors, tampering, and intrusion, so we cannot guarantee absolute security. We keep personal information only as long as needed for the purposes described here or as required by law.

10. Financial information and mortgage inquiries

When you share financial information in connection with a mortgage inquiry or application, that information is also handled under the privacy practices of Guild Mortgage Company, the licensed lender through which mortgage services are provided, and is subject to federal financial privacy laws, including the Gramm-Leach-Bliley Act. We treat nonpublic personal financial information you provide for a mortgage transaction as confidential, use it only to evaluate and process your request, and do not share it with advertising partners for their own marketing purposes. Guild Mortgage Company provides its own privacy notice describing how it collects, uses, and shares financial information, and that notice governs the loan process.

11. Children's privacy

This website is intended for adults and is not directed to anyone under 18. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 13, we will delete it as soon as possible. If you believe a child has provided us information, please contact us.

Our site may link to other websites and tools we do not control, including lender, brokerage, and scheduling platforms. When you click one of these links you move to another website, and that site's privacy practices are governed by its own policy. We encourage you to read those policies, and we are not responsible for them.

13. Governing law and jurisdiction

This Privacy Notice is governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law rules. For any dispute not subject to binding individual arbitration under our Terms of Use, you and Scott Buehler agree to submit to the exclusive jurisdiction of the state courts located in Utah or, where federal jurisdiction exists, the United States District Court for the District of Utah. Each party waives any objection to venue or inconvenient forum in those courts and waives any right to a jury trial. The United Nations Convention on Contracts for the International Sale of Goods does not apply, and no rule requiring that ambiguities be construed against the drafter will apply to this policy.

14. Changes to this policy

We may update this Privacy Notice from time to time. We will post the revised version here with a new effective date. Your continued use of the site after an update means you accept the revised policy.
