These terms govern your use of MovingUtah.com. Please read them carefully. Using the site means you agree to them.

MovingUtah.com (the "site") is operated by Scott Buehler, a dual-licensed real estate agent and mortgage loan originator serving Utah. In these Terms of Use ("Terms"), "we," "us," and "our" refer to Scott Buehler and MovingUtah.com, and "you" refers to anyone who accesses or uses the site.

1. Acceptance of these terms

By accessing or using the site, you agree to be bound by these Terms and by our Privacy Notice, which is incorporated here by reference. If you do not agree, please do not use the site. If you use the site on behalf of a household or organization, you represent that you are authorized to accept these Terms on its behalf.

2. Informational use only

The content on this site is provided for general informational purposes only. It is not legal, tax, accounting, investment, insurance, or financial advice, and it is not a substitute for advice from a qualified professional who knows your situation. Real estate and mortgage rules, costs, taxes, and market conditions change and vary by property and by person. You should confirm anything you intend to rely on and consult the appropriate professional before acting.

Nothing on this site is an offer to buy or sell real estate, a solicitation in any jurisdiction where we are not licensed, an appraisal, or a commitment or offer to lend or to extend credit. Listing information and market figures are believed reliable but are not guaranteed and are subject to change without notice.

3. Calculators and estimates

Any calculators, estimators, quizzes, or similar tools on the site are illustrative only and are intended to help you explore general scenarios. No output from any tool on this site is an appraisal, a guarantee of value, a pre-qualification, a pre-approval, or a commitment to lend. Results depend on the assumptions and figures entered, do not reflect all costs, and will differ from any actual terms you may be offered. For numbers specific to you, speak with a qualified professional.

5. Dual role and referrals

Scott Buehler is licensed in both real estate and mortgage lending. On any single transaction he acts in one role only, never both at once, and that role is disclosed to you in writing. You are always free to choose your own real estate agent and your own mortgage lender. Use of any agent or lender we refer is never required, and one service is never a condition of the other. Where a referral involves a referral fee, that fee is disclosed to you. A full explanation of this model is on the How I Work page.

6. No professional relationship formed by use

Using the site, contacting us, or submitting a form does not by itself create an agency, brokerage, lending, or other professional relationship between you and Scott Buehler. Any such relationship is formed only through a separate written agreement that identifies the role and the terms. Until then, no duty of representation, confidentiality, or fiduciary obligation arises from your use of the site.

7. Your account

Some features of the site, such as saving searches or saving favorite listings, let you create an account, which is provided through our IDX provider. To create or use an account, you must be at least 18 years old and provide information that is accurate, complete, and current. Keeping that information up to date is your responsibility, and out-of-date or inaccurate information may result in suspension or termination of your account.

You are responsible for keeping your password and account credentials confidential, for restricting access to your devices, and for all activity that occurs under your account, whether or not you authorized it. Notify us right away if you become aware of any unauthorized use of your account or any other breach of security. You may not choose or use a username that belongs to another person or entity, that you are not lawfully entitled to use, that infringes anyone's trademark or other rights, or that is offensive, vulgar, or obscene. We may refuse service, remove or edit content, suspend or terminate accounts, and reclaim usernames, in our reasonable discretion.

8. Communications consent

When you provide your phone number or email and ask us to contact you, or opt in to updates, you consent to receive calls, text messages, and emails from us about real estate and mortgage services and your inquiry, including messages sent using automated technology such as automated dialing, prerecorded or artificial voice, and automated text messaging, at the contact information you provide. Consent is not a condition of any purchase or of receiving real estate or mortgage services. Message and data rates may apply, and message frequency varies. You can opt out of text messages at any time by replying STOP, and reply HELP for help. You can unsubscribe from emails using the link in any message, and you can ask to stop calls when we reach you. We will make commercially reasonable efforts to honor opt-out requests. See the Privacy Notice for details.

9. Acceptable use

You agree to use the site lawfully, to abide by all applicable local, state, national, and international laws and regulations, and not to:

  • scrape, harvest, copy, or systematically collect content, listing data, or contact information from the site, or use automated tools to access it, except as expressly permitted;
  • submit false, misleading, or fraudulent information, or impersonate any person or entity or misrepresent your affiliation with anyone, including us;
  • interfere with, disrupt, probe, or attempt to gain unauthorized access to the site, its servers, or any connected systems, or upload files that contain malware, viruses, or corrupted data;
  • use the site to transmit unlawful, infringing, harassing, defamatory, or harmful material, or for any purpose that violates these Terms or applicable law; or
  • reproduce, distribute, or create derivative works from the site's content for commercial purposes without our written permission.

You acknowledge that your use of the internet to access the site is at your own risk.

10. Your submissions and content

If the site lets you submit, post, or send material, such as a form, message, review, or other content ("Content"), you are responsible for that Content, including its legality, accuracy, and appropriateness. You must not submit Content that is libelous, defamatory, harassing, threatening, abusive, bigoted, hateful, obscene, or otherwise objectionable; that infringes anyone's copyright, trademark, privacy, publicity, or other rights; that you do not have permission to share; that impersonates another person or misrepresents your affiliation; that contains malware; or that constitutes spam or unauthorized advertising.

You keep the rights you hold in your Content. By submitting it, you grant us a non-exclusive, royalty-free, worldwide license to use, store, reproduce, modify, display, and distribute that Content in connection with operating and promoting the site and responding to you. You represent that you own or have the right to submit your Content and to grant this license. We are not responsible for Content submitted by users, we have the right but not the obligation to monitor, remove, or edit Content we find objectionable in our reasonable discretion, and we may terminate the account of anyone we find to be infringing.

11. Intellectual property

The site and its original content, design, text, graphics, logos, and compilation are owned by Scott Buehler or used under license and are protected by copyright, trademark, and other laws of the United States and other countries. The Moving Utah name, logo, and trade dress are our marks and may not be used in connection with any product or service without our prior written consent. You may view and print pages for your own personal, non-commercial use. All other use, including reproduction, transmission, or distribution, requires our prior written permission. Listing data and third-party content remain the property of their respective owners.

12. Copyright complaints (DMCA)

We respect the intellectual property rights of others and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. If you believe content on the site infringes a copyright you own or are authorized to act for, send a written notice to our copyright agent at [email protected] with the subject line "Copyright Infringement," or by mail to Scott Buehler, Moving Utah, Cedar City, UT 84720. Your notice should include, as required by 17 U.S.C. 512(c)(3):

  • a physical or electronic signature of the person authorized to act for the copyright owner;
  • a description of the copyrighted work you claim has been infringed, including a copy or URL;
  • the URL or specific location on the site of the material you claim is infringing;
  • your name, address, telephone number, and email address;
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

You may be held responsible for damages, including costs and attorneys' fees, for a material misrepresentation or bad-faith claim. We may remove allegedly infringing material and terminate the accounts of repeat infringers.

13. Third-party content and listings

The site includes property listings and other data provided by third parties, including multiple listing services and our IDX provider, and links to third-party websites and tools we do not control, such as lender, brokerage, mapping, and scheduling platforms. We do not guarantee the accuracy, completeness, or availability of third-party content, and listing information is subject to change, prior sale, or withdrawal without notice. We provide links as a convenience and are not responsible for the legality, accuracy, or appropriateness of any third-party content, and we are not liable for any loss or damage connected with your use of a linked site. Your use of any third-party site or service is governed by that party's own terms and policies, which we encourage you to read.

14. Availability, errors, and inaccuracies

We update the site regularly, and there may be delays between an update of information and its display here. The site may contain errors, inaccuracies, or information that is incomplete or out of date. We do not guarantee the accuracy or completeness of any information on the site and may update information and correct errors, inaccuracies, or omissions at any time without prior notice. We may also modify, suspend, or discontinue the site or any feature, with or without notice, and will not be liable to you or any third party for doing so.

15. Disclaimer of warranties

The site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty regarding accuracy, reliability, or uninterrupted or error-free operation. We do not warrant that the site, or any tool or content on it, will meet your requirements, be available at any particular time, or be free of viruses or other harmful components. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Scott Buehler and MovingUtah.com, and our affiliates, licensors, employees, contractors, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the site or any content or tool on it, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the site will not exceed the greater of one hundred dollars ($100) or the amount you paid us, if any, for access to the site. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless Scott Buehler and MovingUtah.com, and our licensors, employees, contractors, agents, officers, and directors, from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of your use of and access to the site, including use by anyone using your account, your violation of these Terms, your Content, or your violation of any rights of a third party.

18. Termination

We may suspend or terminate your access to the site or any account, immediately and without prior notice or liability, in our reasonable discretion and for any reason, including a breach of these Terms. If you wish to close your account, you may notify us at [email protected]. All provisions of these Terms that by their nature should survive termination will survive, including the ownership, warranty-disclaimer, indemnification, limitation-of-liability, and dispute-resolution provisions.

19. Force majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, fire, flood, earthquake, accident, strike, war, terrorism, governmental action, failure of common carriers or internet service or hosting providers, and shortages of transportation, fuel, energy, labor, or materials.

20. Dispute resolution and arbitration

Please read this section carefully, as it affects how disputes are resolved and limits your rights.

Any dispute arising out of or relating to these Terms or your use of the site will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court. You and we waive any right to a jury trial.

Class-action waiver. Any claim or proceeding between you and us will be conducted only on an individual basis, and not as a plaintiff or class member in any class, mass, consolidated, or representative proceeding. Whether all or part of this class-action waiver is enforceable may be decided only by a court of competent jurisdiction, not an arbitrator.

Arbitration will take place in St. George, Utah, or, at your election, in the county where you reside, and may also be conducted by telephone or video where the arbitrator allows. You may opt out of this arbitration agreement by sending written notice to the contact below within thirty (30) days of first accepting these Terms; if you opt out, neither you nor we will be bound by the arbitration provision (the class-action waiver and jury-trial waiver still apply to the extent permitted by law). If any part of this section is found unenforceable, the remainder will continue to apply.

21. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration section above. The United Nations Convention on Contracts for the International Sale of Goods does not apply, and any rule that an agreement is construed against its drafter does not apply to these Terms. Subject to the arbitration section, the state and federal courts located in Washington County, Utah have exclusive jurisdiction over any matter not subject to arbitration, and you and we waive any objection to venue or inconvenient forum in those courts.

22. State-specific notices

California. Under California Civil Code Section 1789.3, California users are entitled to know that they may file grievances and complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, by telephone at (916) 445-1254 or (800) 952-5210, or by email at [email protected].

New Jersey. Any disclaimer, limitation of liability, indemnification, or damages provision in these Terms applies to New Jersey residents and New Jersey transactions only to the extent permitted by New Jersey law or public policy.

23. Changes to these terms

We may update these Terms from time to time. When we do, we will post the revised version here with a new "Last updated" date. Your continued use of the site after an update means you accept the revised Terms. If you do not agree to a change, your sole recourse is to stop using the site. It is your responsibility to review these Terms for updates.

24. Severability and entire agreement

If any part of these Terms is found unlawful, void, or unenforceable, that part will be severed and will not affect the validity or enforceability of the remaining provisions. These Terms, together with our Privacy Notice and any other terms posted on the site, are the entire agreement between you and us regarding the site and supersede any prior agreements on that subject. Certain areas of the site may carry additional terms, which are made available when you use those areas; if any additional terms conflict with these Terms, the additional terms control for that area. Our failure to enforce any provision is not a waiver of it.
